1. Introduction & Acceptance

Welcome to BazaarTop (“we”, “our”, or “us”). By accessing or using our website at bazaartop.in or purchasing any advertising or listing placement, you agree to be bound by these Terms & Conditions and all applicable Indian laws and regulations. If you do not agree with any part of these terms, you must discontinue use of the platform immediately.

2. Nature of the Service

BazaarTop operates strictly as an advertising, discovery, and promotional directory for Indian independent sellers, Instagram creators, WhatsApp businesses, D2C brands, and craftspeople.

• No E-Commerce Transactions: We do not sell, warehouse, manufacture, package, or deliver any physical products.
• Direct Relationship: When a shopper clicks on a listing, they are redirected to the seller’s own platform (Instagram, WhatsApp, or independent online store). All transactions, payments for goods, shipping, warranties, and returns are strictly between the shopper and the independent seller.
• Paid Advertising Placements: All listing fees, boosts, and claim payments on BazaarTop are solely advertising service fees for visibility on our directory boards. A paid ranking does not guarantee sales, profits, or specific visitor conversion numbers.

3. Listing Eligibility & Rules

To list a product on BazaarTop, sellers must ensure that:

• They have the legal right to sell the product or service in India.
• The product is not counterfeit, replica, hazardous, illegal, sexually explicit, or prohibited under Indian law (including the Drugs and Cosmetics Act, Wildlife Protection Act, and IT Act).
• All product images, titles, descriptions, and destination links are accurate, honest, and not deceptive.
• Destination links point to active, reachable seller storefronts (Instagram profile/post, WhatsApp wa.me chat, or direct shop domain). Affiliate links, redirects, and group invites are prohibited.

We reserve the right to review, reject, or remove any listing that violates our guidelines without prior notice.

4. Payments & Pricing

All advertising payments on BazaarTop are processed securely in Indian Rupees (INR) via Razorpay.

• Pricing Structure: Minimum listing amounts and claim steps are clearly displayed on the platform and at checkout before payment.
• No Hidden Charges: Prices shown on checkout are the final amounts charged through Razorpay.
• Non-Refundable: Because advertising placements are activated upon payment verification, all fees are strictly non-refundable once processed, except in cases of duplicate charges, technical failures, or rejected listings as detailed in our Cancellation & Refund Policy.

5. Intellectual Property

All BazaarTop brand marks, logos, user interface designs, ranking graphics, code, and algorithms are the proprietary property of BazaarTop. Sellers retain ownership of their uploaded product images and descriptions but grant BazaarTop a non-exclusive, royalty-free, worldwide license to display, format, and render promotional share cards for the product on the platform and social media.

6. Limitation of Liability

To the maximum extent permitted by Indian law, BazaarTop and its operators shall not be liable for any indirect, incidental, consequential, or punitive damages, or any loss of revenue, sales, or data arising from:

• The purchase, use, or quality of products sold by independent sellers listed on the platform.
• Disputes between buyers and sellers.
• Temporary technical downtimes, maintenance, or payment gateway interruptions.

7. Governing Law & Dispute Resolution

These Terms & Conditions are governed by and construed in accordance with the laws of the Republic of India. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the competent courts in India.
